The principal distinctions include:
- Guardianship: A California probate court appoints an adult to take legal responsibility for a minor child’s person, estate, or both.
- Child custody: The court determines parental decision-making authority and parenting time, often as part of a divorce, parentage, or custody proceeding.
- Adoption: Adoption creates a permanent legal parent-child relationship. Guardianship doesn’t by itself terminate parental rights, although those rights may be suspended while the guardianship remains in effect.
- Conservatorship: A conservatorship generally concerns an adult who can’t manage personal care, finances, or both. Guardianship concerns a minor.
